A Study on the Enactment and Management of Political Purification Law by the Military Government
The Political Purification Law announced on March 16, 1962 was enforced as part of the military government's full-blown plan to seize power along with the revision of Constitution, formation of Democratic Republican Party, and enactment and revision of Political Party Act and Election Act. According to the announcement, the Law was applicable to total 4,369 people, of whom 1,336 applied for an eligibility judgment to the Political Purification Committee and received an eligibility ruling. The rest of them were banned from political activities until August 15, 1968. They were, however, freed sequentially from the ban before the formal establishment of Third Republic except for 70. The releasing process, which was implemented according to the authority of chairperson of supreme council or the military government's political judgments in reality, was in line with the formation of Democratic Republican Party, expansion of military government's base, and the resuming political activities and reorganization of political topography at the beginning of 1963. The processes of banning certain individual from political activities and then releasing them from the ban according to the Political Purification Law suggest that the Law was operated according to the political needs of military government rather than the establishment of political morality and new political order, which were the nominal goals of the Law. The most decisive precondition was whether the individual would support the military government or not in cases of releasing him or her from the ban according to the eligibility judgment application based on the laws or the authority of chairperson of supreme council. Those findings indicate that the Political Purification Law was enforced as part of the plan to seize power in full scale by the leading influence of the coup and used to expand their political base before an election and disturb the opposition party. In addition, it created a political vacuum, thus spreading political indifference and cynicism according to the absence of alternatives. People's political indifference and cynicism made the best conditions for the military government to revise the Constitution according to its intention and lead politics and elections in its favor.
