金融機關 不實債權 整理에 관한 硏究 : 한국자산관리공사(KAMCO)의 부실채권 정리를 중심으로

This study is not only for the purpose of grouping for the problems in the process of liquidating bad debts, but also for the purpose of grouping for effective solutions. To accomplish this purpose, I will look into the cases that Korea Asset Management Corporation(KAMCO) which plays an important role in the liquidation of bad debts liquidated a great quantity of bad debts after IMF crisis. In principle, weakness of individual financial institutions should be restructured by themselves in private section. However, government is involved in the weakness of individual financial institutions in case that they have no ability to overcome it or if the causes of insolvent finance can make a bad influence on the whole section of financial systems Accordingly, after IMF crisis, government has pooled Non-Performing Loans(NPL) adjustment fund and deposit insurance fund under article 7 of account law to liquidate a large quantity of bad debts of financial institutions and to prevent additional weakness. Government assigned the former to KAMCO as the whole responsbility organization of NPL adjustment and the latter to KDIC as an institution of deposit sudstitute supply or payment guarantee. This thesis focuses on NPL adjustment work of KAMCO, the whole responsbility organization of NPL adjustment looking into instances that KAMCO purchased and liquidated bad debts. And also, this thesis intends to search for reform measures in the current situation to reduce burden of people and to liquidate bad debts quickly. Firstly, I observe basic conception of bad debts, causes of occurrence, and current situation. After that, I raised rightfulness of liquidation of bad debts and need KAMCO with examples of harmful effects to general financial institutions and to whole society. The disposing of financial institutions' NPLs is essential factor in financial restructuring so government already input enormous 'public fund' of 20.5 billion wons through KAMCO. KAMCO should dispose NPLs as soon as possible, and, at a same time, also relieve the pressure on pulic burden by effective operation. This thesis also focused on these points. But, in this thesis, I did not make comprehensive study which covers KAMCO, KDIC, and all other institutions in charge of financial restructuring, and I couldn't make any solution to prevent financial insolvency. Therefore, from now on, these macroscopic, systematic aspects and preventive methods of NPLs will have to be more studied.
